What does it mean when a Judgement of Foreclosure and Sale has been filed?


A Judgement of Foreclosure and Sale comes near the end of the foreclosure process. When the lender (considered the Plaintiff in a foreclosure case) files a motion for a Judgement of Foreclosure and Sale, they are asking the court for an order to allow your home to be sold at auction. A judge can make a decision at any time, but in New York typically a decision is reached within 6 months of filing. In the great majority of these motions the decision is usually in favor of the lender clearing the way for an auction to be held. Generally, a lender will advertise the foreclosure auction date of your property in various local publications and conduct the sale at the courthouse within 45 days. Homeowners who have reached this stage of the process are urged to consider all possible options to avoid foreclosure prior to a Judgement of Foreclosure and Sale being granted by the courts.
