A Foreclosure Defense Grant provides funding for a comprehensive legal review of a pending foreclosure action. Just because a bank (mortgagee) has a mortgage on a property it doesn’t mean they own it! It also doesn’t give them blanket authority to foreclose and repossess a property, even if a borrower has defaulted. To foreclose on a property the bank must establish they have the legal authority to so and then must meet specific legal requirements and timelines required by law. Using a Foreclosure Defense Grant, homeowners who are facing foreclosure get a complete legal assessment from a designated law firm to assess whether a mortgagee has established the right to foreclose and has met all the legal requirements to do so. It’s not uncommon to find procedural and other errors by the mortgagee given the complicated judicial process. All Grants are privately funded; so legal services are paid and cost homeowners nothing. Properties must be located within the five boroughs of New York City, Long Island and Westchester. Most applications receive a decision in 24 hours or less. Funding and eligibility are limited. Not all homeowners are eligible.*
